Super Vision Responds To Summary Judgement

Super Vision International, Inc. (NASDAQ: SUPVA), today announced that it will appeal the United States District Court for the District of Massachusetts granted motions against Super Vision on Color Kinetics Incorporated’s assertions that five of Super Vision’s color-changing LED products infringe one or more of the claims of Color Kinetics’ patents.

In addition, the Court ruled against Super Vision’s arguments that each of Color Kinetics patents in the case were invalid because of prior art and/or inequitable conduct before the U.S. Patent Office in the applications for those patents. Super Vision believes that errors of fact and law pertaining to invalidity and inequitable conduct provide even further strong grounds for appeal.

The ruling did not assess any damages against Super Vision. The Court will separately schedule a trial on the question of damages.

Super Vision’s previous appeals against earlier rulings of the Court on discovery are currently pending in the U.S. Court of Appeals for the Federal Circuit.
